Winning a planning appeal in the Wirral, Liverpool

A previous application not made via NAPC, for a luxury single-storey detached garage in the front garden of a primary residence was refused.  Due to concerns regarding its siting and scale.  The initial planning permission application was considered by the Local Planning Authority (LPA) to have a harmful visual impact on its surroundings. We were instructed to submit an appeal so that our client could build the garage they needed to store their collection of luxury cars. Our task included writing an appeal as well as progressing a new planning application for the building in Newton. The dwelling comprised a contemporary, detached single-storey garage with a white rendered and brick façade.

Our team took decisive action against the LPA’s refusal by lodging a detailed appeal using the written representation procedure. Our appeal statement provided a detailed explanation of how boundary treatments at the site ensured that the garage would be concealed from nearby properties. It strongly emphasised how the proposed development complied with planning policies. Furthermore, respected the site’s location by being appropriately set back from the road.

We made it clear to the inspectorate that several garages and outbuildings had already been erected in front of residences in the vicinity.  Given that construction had already been sanctioned, a precedent had been established.

Success!

We were delighted to receive news from the LPA  that our appeal was successful. In allowing the appeal, the Inspector concluded that the garage would not overly dominate the street scene.  Nor cause a significant visual intrusion to the surrounding area. The Inspectorate also set out how the proposal complied with the other elements of the development plan.
